Bruchou, Fernández Madero & Lombardi’s tax practice is highly recommended for its ‘outstanding tax advice on M&A deals and international tax planning’. The team is also recognised for its tax litigation abilities and for its day-to-day tax advice to a stellar clientele including Central Puerto, Construtora Norberto Odebrecht, Molinos Río de la Plata and Casino Group. On the litigious side, recent matters include assisting shareholders of HSBC Bank in the worldwide tax litigation case related to the ‘Swiss leaks’, and acting as defence co-counsel to Bunge on a transfer-pricing case; the team also obtained a favourable first instance judgement for Despegar.com in a criminal case related to an income tax assessment. On the transactional side, the team handled the tax aspects of Nexans Group’s sale of its local subsidiaries (Nexans Indelqui and Nexans Optel) to Cimet; Perez Companc Family Group’s acquisition of 100% interest in Skanska Argentina (now Pecom Servicios Energía); and is advising Grupo Bimbo on the $40m project financing granted by Banco Santander Río for the construction of a production plant facility in the province of Córdoba. The ‘exceptional’ group of partners includes Matías Olivero Vila, Liban Kusa, Ezequiel Lipovetzky and Eduardo Mallea and ‘is exceptionally proactive. The tax practice at heavyweight Marval, O’Farrell & Mairal is now led by five ‘highly qualified’ professionals following the incorporation of María Inés Brandt from Tanoira Cassagne Abogados in early 2015, and the recent promotion of Fernando Vaquero, who is both a lawyer and an accountant. These two join the immensely experienced trio of Gabriel Gotlib (who focuses primarily on advice planning and litigation), Walter Keiniger (transactional tax matters, corporate reorganisations and tax planning and litigation), and Horacio García Prieto (tax and customs advisory and litigation). The firm has earned enormous prestige for its work on sophisticated tax structures, complex cross-border transactions and high-profile litigation cases. In on-going matters, Keiniger is leading advice to AMX Argentina (Claro) regarding an AR$1.6bn municipal tax assessment (and has filed a claim before the Administrative Arbitration Commission-CACM); García Prieto continues to defend Cargill before the Argentine Customs Authority regarding the application of export duties and is also advising Panamerican Silver (Minera Tritón) on its opposition to the application of a new tax established by the province of Santa Cruz; Gotlib has been advising a major financial institution on matters relating to a data leak and is also advising a ‘new economy’ client on the negotiation of a suitable tax regime. Brandt has been active on reorganizations and clients note that ‘apart from her deep knowledge of tax matters, she is a very amicable person and very close to her clients’. Senior associates Juan Pablo Rothschild, Valeria D’Alessandro and Soledad González are also highly recommended. New panel wins include Dow AgroSciences Argentina, Dow Química Argentina and Basf Argentina.

International giant Baker & McKenzie has a significant profile in the Argentine tax market thanks to the capable local practice led by Martín Barreiro and Juan Pablo Menna, and which also counts on the close participation of Esteban Rópolo. The 11-strong team provides ‘very good advice on complex tax matters’ and has great expertise on transfer pricing-related cases. Notable mandates include assisting several agribusiness companies in multimillion-dollar litigation cases concerning the exportation of agricultural products and arising from the transfer-pricing assessments made by the tax authority. In one recent cross-border matter, Barreiro and Menna are advising a consumer goods company in connection with the intercompany transfer of its beverage arm, involving countries in the Americas and Europe. A high profile client roster includes Hilton International, Lexmark, HBO and Club Med.

Specialised boutique Bulit Goñi & Tarsitano has established itself strongly since its incorporation in 2012 under the leadership of the well-respected and experienced Enrique Bulit Goñi and Alberto Tarsitano, who are considered ‘two of the most recognised tax lawyers in the country’. Bulit Goñi specialises primarily in tax litigation, while Tarsitano is focused on transactional tax matters. The firm advised a notable roster of local and international clients (including Chevron, Dupont Argentina, JP Morgan and Rolex) on a broad spectrum of tax matters including corporate tax, complex litigation and criminal-related cases. The firm also has strength in depth and both tax litigator María Inés Giménez and Ignacio Pampliega, who focuses on economic and fiscal criminal law are noted.

Niche firm Rosso Alba, Francia & Asociados focuses on providing international and domestic tax advice, and is ‘a force to be reckoned with’ for contentious and non-contentious transfer pricing matters. The firm is recommended for its ‘excellent services’ and founding partner Cristian Rosso Alba considered an ‘outstanding professional’ with ‘amazing technical expertise’ and ‘sharp knowledge of the area’. The firm was instructed by CIARA-CEC (the Argentine Chamber of Grains and Oilseed Exporting Companies) to provide a technical opinion as to OECD proposals for amending the transfer-pricing guidelines related to commodity exports. In the utilities sector, Rosso Alba is assisting Endesa Group on tax controversies related to debt-to-equity tax re-characterizations by the Argentine fiscal authority. Elsewhere, the firm acts as co-counsel advisors to Bunge and Glencore’s local affiliates on their transfer-pricing disputes. A former head of tax at KPMG Argentina, Juan Manuel Soria has a strong constitutional law aspect to his practice and is also recommended.

Established in 2012, Teijeiro & Ballone, Abogados has a great reputation for its work with domestic and multinational corporate clients, as well as for its advisory services to high-net-worth individuals, across the entire range of tax matters. The deeply experienced Guillermo Teijeiro has a regional reputation and is ‘go-to’ on matters including corporate and international taxation; transactional tax matters; indirect taxtation, VAT and customs duties; and tax controversies (including transfer pricing matters). Mariano Ballone advises on domestic and international corporate and individual tax planning, and has particular expertise on matters incuding the tax aspects of corporate finance and private equity investments. Representative matters include acting as lead counsel to Bunge on several transfer-pricing adjustment cases (including strategy definition and representation of the company before administrative and federal tax courts); and advising Noble Argentina on tax-planning related to the tax impact resulting from the hedging of commodities positions in international markets. Gloria Gurbista is also recommended and Ana Lucía Ferreyra moved in house at Pluspetrol. Other clients include Siemens Argentina, Atento and CMS Energy.

At Asorey & Navarrine, the experienced Ruben Asorey represents clients on tax planning, fiscal due diligence, transfer pricing and litigation matters; he is particularly praised for his expertise on tax-free reorganisations. Clients suggest that ‘the firm outshines many of its competitors’ and is always willing to ‘walk that extra mile for its clients’. Asorey is ‘one of the Popes of Argentine tax law’, while associate Ana Verardo is considered ‘a rare gem; very knowledgeable on corporate, civil and commercial law matters, a good background in pharma and remarkable interpersonal skills’. The team has advised a list of big-league clients including Coca-Cola, Schweppes, Merrill Lynch, Nestlé, IRSA, Fox Latin American Channel, Avon, Bunge & Born and Burger King.

Luna Requena & Fernández Borzese Abogados’ co-founding partner Alvaro Luna Requena is highly esteemed for his work on all types of tax controversy, in both administrative and judicial stages. In representative matters, the firm represented a group composed of multinational and local food companies in taxation challenges before the Federal Tax Court. Ignacio Fernández Borseze is also noted for his practice on the tax side of local and cross-border transactions, company reorganisations, real estate projects, securities issuances and transactions involving intangible goods or services. He also advises on transfer pricing matters.

At M & M Bomchil, the tax practice reports a significant volume of international transaction-related work, primarily involving tax planning and tax due diligence processes. The team, led by the very experienced Alejandro Messineo, has been active with top-drawer clients on federal tax matters involving transfer pricing controversies, the application of international tax treaties to income tax, and VAT on the import of services; it has also undertaken tax litigation, advising on cases related to the application of personal assets tax to the participation of foreign companies in local corporations, and tax claims arising from the tax authorties’ re-characterization of debt as capital contributions. Ariadna Artopoulos is highly recommended. Clients include the Argentine subsidiaries of Alstom, BASF, PepsiCo, Schlumberger and Nextel, along with CNP Barclays Vida y Pensiones, Edesur, Endesa and Pramer.

Estudio O’Farrell has a very competent tax practice led by ‘experienced practitioner’ Miguel Tesón, who is recommended for his ‘technical excellence’. Clients also note ‘outstanding levels of service’ provided by a ‘very solid’ group of lawyers. Recent matters include a complex tax litigation case in which the team is representing Droguería del Sud on administrative and judicial claims before the competent authorities regarding the applicability of turnover tax; it simultaneously filed a specific claim before the Federal Tax Court, successfully obtaining a preliminary injunction. Other matters include representing Ford on a claim initiated by the tax authority of the province of Buenos Aires in a one-of-a-kind double local taxation case regarding turnover taxes. Also noted are Guillermo Lalanne, who is recommended for his ‘excellent abilities on provincial and local tax matters’, along with Valeria Estathio and María Celina Valls.

Pérez Alati, Grondona, Benites, Arntsen & Martínez De Hoz, Jr’s tax practice is led by deeply experienced and highly-regarded departmental head Manuel Benites with close support from key partner Marcelo Núñez and the recently promoted Maximiliano Batista. Benitez is a prominent figure in tax circles and provides sophisticated advice on the tax aspects of major corporate transactions and restructurings, as well as on tax litigation cases. Núñez focuses on complex local and federal tax litigation, while Batista works on cross-border transactions. The team recently advised Point State Capital on the tax aspects of its purchase of 50% of local sustainable energy company, Genneia (formerly Engasud). The team is also known for its long-standing representation of grain exporter Louis Dreyfus Commodities, notably in a series of cases regarding challenges to the deductibility of certain purchases of grain, and more recently in relation to VAT matters As of late, it has been active defending several companies against personal assets tax claims from the Federal Tax Administration, specifically in relation to the availability of exemptions under the Spain-Argentina tax treaty. Other clients include Shell CAPSA, Total Austral and Jumbo Retail Argentina – Cencosud.

In addition to providing day-to-day tax advice, Allende & Brea’s tax department handles tax planning and structuring, tax audits, transfer pricing and tax free reorganizations, and double taxation matters, as well as representing companies in tax-related administrative and judicial appeal proceedings. The team is led by Diego Botana, whose recent caseload includes advising Oroplata S (Goldcorp’s local subsidiary) on the tax implications arising from its initial exportations of doré extracted from the recently constructed Cerro Negro mine. Other clients include MetLife, FMC Corporation (Lithium Division) and the newly retained Marriott.

Santiago Montezanti leads the experienced tax practice at Estudio Beccar Varela, which handles a broad range of tax work and is particularly active in tax matters related to M&A and cross-border transactions. The team is also well known for its expertise in the pharmaceutical, banking and credit card business sectors. Among recent notable engagements, Montezanti advised Prisma (formerly Visa Argentina) on the fiscal aspects of its acquisition of a property in Buenos Aires’ ‘tech district’, as well as on the preparation and implementation of an action opposing Buenos Aires’ province’s intention to charge credit card accounts with extra taxes. Senior associate Ezequiel Martínez is also recommended. Key clients include GlaxoSmithKline Argentina, American Energy Partners and Bank of America.

The tax practice at Beretta Godoy draws upon the expertise of Omar Beretta and Sebastián Nordemann. Beretta’s tax practice covers domestic and international tax planning, double taxation avoidance treaties, tax-free business reorganizations, tax-efficient financial structures and mining investment regimes. Nordemann works mainly on corporate tax planning and tax controversies related to domestic and international transactions. Recent work includes advising MFC Commodities, and its local affiliate ACC Resources, on day-to-day tax issues related to corporate financing, and tax audit matters. The practice, which has also developed a notable speciality in assisting high-net-worth individuals, is led by Sebastián López Sansón (formerly the head of international taxation at Estudio O’Farrell); it also has particular expertise in tax planning for IT-related businesses.
